The 12th, Marian Price, gay issues... George Galloway talks tough in Belfast

MP George Galloway has said that dissident republican Marian Price should be freed.
The politician was speaking last night at the Belfast Feile.
He told the West Belfast Talks Back session: “The courts freed Marian Price so she should be freed”, adding he did not support her “political line” and if she reoffended she should be charged and brought before the courts.
Mr Galloway then revealed he had just spoken to the 58-year-old prisoner, convicted of bombing the Old Bailey, while talking to her husband Jerry McGlinchey.
“I have just spoken to her on the phone for the first time and she's not a well woman,” he said. “For all the damning with faint praise, and Ruth Dudley Edwards' reference to her ‘remarkable recovery’ (after Price's 1973 hunger strike), the courts decreed she should be released and it's time to free Marian Price.”
Alongside Mr Galloway on the panel was a rainbow coalition of opinion-makers and politicians: DUP MP Gregory Campbell, author Ruth Dudley Edwards and Sinn Fein MLA Gerry Kelly.
The first half of the debate discussed, without resolving, Syria and the Middle East question.
Opinion divided pretty much along sectarian lines, with Galloway and Kelly regarding Western inaction on Syria as hypocrisy and part of a ploy to destabilise Iran.
Gregory Campbell and Ruth Dudley Edwards, in different ways, pointed out the complexity of the situation and the fact that the situation after any Western intervention might not look better than before.
After broadening talk out to Israel and Palestine, Ms Edwards caused some hissing in the audience by suggesting the Feile might introduce an Israeli representative to “hear the other side”.
It then moved on to gay issues which led to some agonising from Mr Campbell, although his statement of concern that marriage between a man and a woman could be undermined by acceptance of the “lifestyle” of the lesbian and gay community received surprising support from George Galloway.
The Respect MP for West Bradford caused amusement by saying you couldn't promote homosexuality — “you either are or you aren't” — and adding that attendance at any number of Pride marches would not change his orientation.
The debate turned to recent trouble over July 12, with a discussion over whether the Orange Order should be banned following a band's misbehaviour and the singing of ‘The Famine Song’ outside a Catholic church.
Discussion was fierce, and intensified later between Messrs Campbell and Kelly over whether the former would ever shake hands with the latter.
You can only hope that these exchanges are in some way cathartic.

Owen Paterson, the Secretary of State for Northern Ireland, has written a letter to the editor of The Guardian (London) attempting to justify imprisoning Marian Price. I’ve included his letter below.

Paterson makes two essential points:
  • That Marian Price was released on “license”, parole in American terms, which he had the right to revoke.
  • That he does not have the legal right to release her because it can only be done by the Parole Commission.

Unfortunately for Mr. Paterson, neither is true.

He claims she received a royal pardon “the Royal Prerogative of Mercy” for a 20 year sentence related to the Old Bailey bombing but was on license for a life term for the same bombing.

If so, this would have been a strange and meaningless order. Granting a pardon for a 20 year sentence while simultaneously releasing someone on license from a life sentence would have achieved absolutely nothing.

If Mr. Paterson seriously believes the royal pardon doesn’t apply to Marian Price’s life sentence, all he has to do is produce it. Instead he states that the only copy of the pardon has been lost or shredded. Marian Price’s solicitor, Peter Corrigan, says that this is the only time in the entire history of the Royal Prerogative of Mercy that a pardon has gone missing.

Paterson also states that he can’t release Marian Price because “It would be outrageous for any secretary of state to do anything other than adhere strictly to the law.”

But the Life Sentences (NI) Order 2001 proclaimed by “Her Majesty” provides explicitly that “The Secretary of State may at any time release a life prisoner on licence if he is satisfied that exceptional circumstances exist which justify the prisoner’s release on compassionate grounds.”

There could hardly be more “compassionate grounds” for releasing Marian Price. United Nations doctors who examined her in July reported she was “unable to comprehend the allegations being made against her to sufficient degree to inform her defence” and that “she would be unable to follow the evidence in her own hearing as she lacks the ability to attend to detailed evidence”. She is presently hospitalized with pneumonia.

If Owen Paterson is serious about enforcing British law, he should release Marian Price immediately.

You refer in your editorial (Northern Ireland: keep focused, 28 July) to the case of Marian McGlinchey (nee Price). I should be grateful for the opportunity to set out the facts.

Marian McGlinchey received two life sentences in 1973 for her part in the Old Bailey bombing. She was subsequently released on licence in 1980. At the same time she was granted the royal prerogative of mercy (RPM) in respect of a separate conviction which carried a 20-year fixed term sentence. The RPM did not cover her life sentences.

All life sentence prisoners remain on licence for life. They can be recalled at any time if they breach the conditions of their licence or pose a risk of serious harm to the public. A similar system was endorsed by the previous government in the legislation to give effect to the part of the Belfast Agreement that dealt with the early release of prisoners.

Before revoking a prisoner's licence under the Life Sentences (Northern Ireland) Order 2001, however, the secretary of state must first seek a recommendation from the wholly independent parole commissioners. This is what I did in the case of Marian McGlinchey; their recommendation was that she was in breach of her life licence. Consistent with my overriding responsibility in Northern Ireland for public safety, and in accordance with the law, she was returned to prison.

The independent parole commissioners are now reviewing the case in full. If they are satisfied that it is no longer necessary for the protection of the public that the prisoner should be confined, then they may direct the prisoner's release. The prisoner has full legal representation and can challenge the case made against her; Marian McGlinchey has yet to do this. The decision of the parole commissioners is final and cannot be overruled by the secretary of state.

It would be outrageous for any secretary of state to do anything other than adhere strictly to the law. Yet the clear inference in your editorial is that I should discard due process and interfere politically in this case. That would fatally undermine the rule of law in Northern Ireland. That is not something I am prepared to do.

we had three from you of the same thing. Nothing goes up automatically so somebody needs to be online here before you can get your comment posted.

But to your point. People should not be in prison for what they thought or didn't think. What she should have thought - no matter how valid you think your point to be - is immaterial to the fact that she is being imporisoned without trial and the British government is dissembling to cover that up.

The same logic argued here by Sandy would be applied if a loyalist was in the position that Marian Price finds herself.

A Royal perogative of Mercy is a State document and as such it's unlikely it was shredded as previously stated. As it's a State document it should be now in the public domain under the Freedom of Information Act, so over to you Mr. Paterson, to shred a State document is illegal.

It is similar to Danny Morrison's arrest years ago for having in his possession a statement from the IRA. His argument was he didn't write it in fact since it was in pen it could have been copied from the original. He also explained that it could have easily been a hand written copy of a loyalist statement.

I know it does not contain the same key facts but maybe there is some legal ruling from Danny's case which could apply in this instance?

Today The Pensive Quill features guest writer Mick Hall who blogs atOrgansied Rage. Here he takes issue with the ongoing internment of the Irish republican political prisoner Marian Price.

After the British Viceroy in Ireland Owen Paterson revoked her licence last year, Irish republican Marian Price has now been held without trialfor over a year. Never mind from day one this decision was surrounded in controversy as the British government were unable to provide the license claiming it has been lost. This is not a small matter as her lawyers claim it no longer stands having been revoked, expressing his concern Daniel Holder, Deputy Director of the Committee on the Administration of Justice (CAJ) had this to say about Marian Prices case: 
The case of Marian Price is particularly striking, as on the same day a Judge released her on bail in May 2011, a government Minister returned her to prison. There are other due process issues in relation to this case, not least the fact she was given a pardon under the Royal Prerogative of Mercy. The NIO claims this document only related to Marian Price’s fixed term and not life sentence for which a licence applied. Her family contest that the pardon related to both, and hence believe that the NIO had no licence to revoke. It would seem a relatively simple matter for the NIO to produce the document to settle the matter. However, apparently the pardon and all copies of it have gone ‘missing.’ Given that it could possibly change a decision as to whether a person is deprived of their liberty, one would think an investigation would have taken place as to how and when the information disappeared. CAJ has been told that the NIO have decided not to investigate this on the grounds that the pardon is ‘not relevant’ to this case.

Whatever the truth of this, the charges on which Marian was first arrested have now been dismissed, as the British judicial system in Ireland failed to submit the necessary papers that would have allowed the judge hearing the case to consider its merits. Judge McElholm reached the conclusion the prosecution had long enough to produce the necessary papers to the defence, yet failed to do so and threw out the case against Ms Price and her co defendants.

Yet still the Tory Viceroy Owen Paterson refuses to release Marian from prison. She remains imprisoned without charge or trial, which is internment by most civilised people's standards. To make matters worse she has been held in solitary confinement since she was first arrested and imprisoned, first at the top security Maghaberry jail and since February this year in Hydebank prison.

Understandably aged 57, solitary confinement without a tariff;  and a lack of exercise have taken its toll on Marian, according to her husband Jerry McGlinchey his wife's health has deteriorated rapidly since she arrived in Hydebank:

Marian is so ill that she had to be taken to a recent visit in a wheelchair. Her hair is falling out, she has lost a lot of weight, and her arthritis has got worse. She is suffering from severe depression after a year in solitary without any release date. The doctors in Hydebank have told us she's not fit to be in jail, according to them she should either be in hospital or at home.

To oppose her continued imprisonment and call for her release does not mean one is a supporter of Marian’s political beliefs, nor the organisation she belonged to at the time of her arrest. Her detention is a travesty of justice and harks back to the dark days of British rule in Ireland. You cannot have one law for some and a different law for political opponents. Such is the road to hell. If the history of the British in Ireland proves one thing, for justice to succeed it must be conducted before a judge and jury and in open court for all to see, not behind closed doors on the signature of a British politician's pen.

If the British governments representatives in the six counties believed Marian Price had committed a crime they should have processed the charges in the appropriate time period and left it for court of law to decide. This they failed to do as was clearly demonstrated by Judge McElholm when he threw out the case last week.

It is high time Marian Price was released from prison, she would not be going any where but home, if at a later date the judicial authorities in the six counties conclude they have a viable case against her, all they need do is knock on her door, something they had no difficulty doing a year ago.

To keep this sick and ageing woman in jail any longer is a judicial obscenity which reeks of bad law. Marian Price should be released immediately.

BLOODY MINDED CULTIVATED BRITISH SADISM OCCUPIED IRELAND






In Nazi Germany, foxhunting with hounds was banned by Hermann Göring on July 3, 1934 extended to Austria after Hitler annexed the country. The director of Germany's hunting museum in Munich, said at the time, "The aristocrats were furious." It was not until the 21st century that a British Government inquiry into hunting with dogs by a senior civil servant Lord Burns, resulted in action to ban foxhunting, with the exception of British Occupied Ireland.



The Burns Inquiry committee reported that:



"There are those who have a moral objection to hunting and who are fundamentally opposed to the idea of people gaining pleasure from what they regard as the causing of unnecessary suffering. There are also those who perceive hunting as representing a divisive social class system. Others, as we note below, resent the hunt trespassing on their land, especially when they have been told they are not welcome. They worry about the welfare of the pets and animals and the difficulty of moving around the roads where they live on hunt days. Finally there are those who are concerned about damage to the countryside and other animals, particularly badgers and otters."



The main type of hunting hound are the English Foxhound, while the horses are often a cross of quarter Irish Draught, with the remainder English. Sadistic, satanic like rituals are an important part of the foxhunt tradition. For example, one important satanic like ritual, which is kept secret, away from the modern media, is the act of blooding children to foxhunt. This is an old ceremony in which the master or huntsman, smears the blood of the fox onto the cheeks of an often very young child, newly initiated into foxhunting. Hunts still cut off tail ('brush'), feet ('pads') and head ('mask') as trophies, while the carcass is still warm and alive, then they are thrown to the hounds to rent asunder. These practices are now also hidden in secret, away from the modern media and public eyes.



Hunts take young hounds out cub hunting in the autumn of every year, to rip and kill young foxes, before they are 10 months old, while still living in their family group.The purpose is to teach and cultivate young foxhounds, to get a taste for hunting foxes, who sometimes mistakenly rip cats and kittens apart instead. This activity now takes place only in the Occupied Ireland part of the UK, as the locally elected native Irish are not allowed by the unelected English Tory autocrat Paterson to ban foxhunting, as the unelected English Tory overules them, to reserve the pleasure of the cruel sport for his visiting English gentry friends. Almost everything of consequence is run by the unelected English Tory despot, while the restless Irish natives are allowed power-sharing over scraps.



Paterson's friends in the English gentry who fly over regularly to feed their blood lust addiction on this cruel blood sport, two or threes times a week initially practice "holding up"consististing of driving loyalist hunt supporters to surrounding a covert, with the English horsey set and orange foot followers, driving back any of the still suckling baby foxes trying to escape. They then "draw" the covert with their own young puppies, with a few more experienced blood hounds, in the process, teaching and cultivating the young to acquire their own blood lust to attack and rip the helpless baby foxes apart while inside the surrounded wood away from prying eyes. The young hound can be then "entered" into the pack, once it is blooded like the young hunting children, creating a blood lust and an addiction for blood thirst in both, in this manner. About 1 in 50 more more evolved foxhounds, who are not blood thirsty enough, must be removed from the pack immediately, so as not to set a bad example, similar to the internment of restless natives in Occupied Ireland presently.



During the debate in the House of Commoners to ban fox hunting, the English Iron fisted Tory ruler of Occupied Ireland, Owen Paterson, compared supporters of the legislation to ban foxhunting to Nazis. Mr Paterson said, hunts drew young people into a 'social network that will last all their lives'.He warned Labour MPs: 'Before they troop through the politically correct lobby, brimming with self-righteous bile and spiteful prejudice, they should remember the unhappy precedent of 1936 when the revolting Reichsjaeger Hermann Goering persuaded Hitler to ban hunting.


'We should not create criminals lightly. No-one gained in Germany then. No-one will now. A ban will be an ominous portent of further freedoms to be lost at the hands of an intolerant majority.'



His defence of foxhunting has been dubbed utter hypocrisy, bearing in mind his destruction of the Peace Process in Ireland, breaking the agreement with the reintroduction of political internment without trial of Irish woman Marian Price and any other Irish people who dare to oppose the cruelty of British occupation in Ireland. The autocratic Paterson besides overruling the British Fox hunting law with respect to Occupied Ireland also overrules the local sectarian mentored Stormont Parliament, thus preventing a ban on foxhunting attempted by the restless Irish natives. This unelected Tory despot has also overruled two judges, ordering the release of Marian Price who had ruled her no threat to society. He also has overruled Her Majesty Queen Elisabeth who ordered the release of Marian Price with a royal pardon. Medical professionals have dubbed this behaviour as simply insane, coupled with his recent homage to his idol, the arch-sadist Ghengis Khan by abusing horses for 10 days whipping them relentlessly onover 1,000 kilometers, in what is dubbed the Mongolian Derby.





Bill Etherington a Labour MP of the House of Commoners in Britain said: “I consider that fox hunting is as barbaric a method of destroying a fox as it would be possible to imagine.”



The vote, by 387 to 174, a majority of 213, sets up "The ‘Compromise’ option, allowing hunting to continue as a licensed activity, Paterson and his crew scuttled it, promising to make foxhunting happen in Britain again despite the wishes of the clear majority. Legal professionals have dubbed his political activity, as a most serious crime of perverting the course of justice, which carries a life sentence in prison for British commoners as they a referred to by the horsey set and gentry friends and family of Paterson.



Even Nicholas O'Hare, hunting columnist said:



"This is the key issue. Is hunting cruel? The answer, of course, is that it is. How can such cruelty be justified? The answer is that it cannot."



Like illegal activities of dogfighting, badger baiting and cockfighting, the only purpose of foxhunting is to satisfy a small minority of bored idle-rich gentry, with nothing else to do and cultivate a bloodlust killing instinct in their young, to maintain the dominance of their blood lines over ordinary, decent people, who are disgusted by such depravity both at home and overseas. This orgy of blood letting, blood thirst, blood lust, call it what you may is the rock on which their IMperial military society is built, that produces commoners as cannon fodder, to fight imperial, neo-colonial wars, at least every five years, for the easy blood money, profit of their lucrative, industrial war complex.



The English and Orange hunters in Occupied Ireland meet two or three times per week during the foxhunting "season," which is between November and April. Local collaborating landowners and some occasional sympathetic "shame fein" castle farmers will keep the English hunters informed of all fox activity, while suitable kill areas in the locality will be set up.The bloodhounds are sent to scent out a fox and force it out in the open.



The chase of blood lust and a kill, often continues for more than hour, with a crowd of frenzied gentry baying for blood. This is the part of the hunt, "field" in which they sate their idle rich boredom and cultivate their craving for blood, as they jump fences, walls and ditches chasing as a lynch mob the fox, who will go anywhere to escape the blood hounds and bloodlusting gentry. He will try to go down a fox-hole or badger sett but they are probably blocked the night before by orange or "me fein" hunt collaborators.



The fox is often chased to exhaustion when he or she will be caught and savaged to death by baying blood hounds and bloody minded gentry. Foxhounds are specially bred for stamina, not speed, to make foxhunts last, otherwise it would spoil Paterson and his friends fun by being caught too soon. Many suspect Paterson and his bigoted, sectarian friends are having the same sadistic fun currently at Marian Price's expense. She has been interned in solitary confinement for almost a year now, for no other reason than this, sick, perverted, sadistic-sexual craving to dominate.



Many agree that fox hunting is the most sadistically cruel of all the blood "sports". The purpose of fox hunting is pure sadistic pleasure, sometimes cultivating a sexual addiction, sometimes sadistically, sexually, sating an otherwise impotent older man, as horsewhipped hunters chase the fox to exhaustion for an hour or more before the animal is literally torn to pieces by the baying hounds and crowd. This long and protracted suffering is an essential element and a desired part of this blood sport in the eyes of the hunters.
If the the control of fox numbers were its aim, faster dogs would be used or the foxes could be shot. All animal welfare organisations and sane people worldwide, with the exception of Paterson and his blood junky ilk in denial, condemn the barbarity, sickness and savagery of fox hunting. It is ineffectual as a form of fox control, a false argument used as an environmental benefit, to try and give this horrific blood sport a veneer of respectability, which close scrutiny of it and its proponents like Paterson, show just how much it is flawed.



There is an alternative for those who claim to enjoy working with hounds and riding over open country, its called drag hunting, with a scent laid for hounds and riders. Drag hunting provides a test for hounds and riders avoiding, unlike fox hunting, serious damage to house pets, crops and scared sheep. However sadistic gentry and die-hard foxhunter defenders, like the unelected English Tory dictator in Occupied Ireland Paterson, ridicule drag hunting with whinging like, "it's not really hunting." Yes indeed, there is one vital difference for craving cultivated, bloody minded sadists, who are in addiction denial, there is no kill in drag hunting to give them their sick fix.





Indeed there are several hunts exclusively practicing the more civilized drag hunting in Ireland. By eliminating the unacceptable cruelty of foxhunting junkies, they ensure the long term survival of the genuine sporting aspects of "hunting" as a tradition with hounds.Many Protestants in Occupied Ireland are disgusted with Paterson too. One respected gentleman commented;



"To even consider allowing ruthless, barbaric,cruel and sickening out dated sports?suggests a man, or two..who are unfit to represent decent ,compassionate human beings. It is not just about fox hunting, although, this concerns me greatly of course, it is also about how he/they are showing the darker and sickening side of violence, aggression, and im sorry, where is the fairness?..If he/they are happy to allow this as acceptable, what is next?



I PRAY that blood sports are NOT something, that can be passed off, as necessary, when it clearly is not..it is a pompous, disgusting, old upper class tradition…farmers DO NOT NEED THIS..it is just another lie, fed to excuse a sickening habit..Did YOU KNOW, THAT THERE ARE PRO HUNTERS BREEDING FOXES, JUST TO HUNT THEM?

He claimed only 'honest, decent' people went hunting and the alternatives of trapping and snaring were 'hideously cruel'. A ban would do terrible damage to sheep farmers, he said.


Paterson argued hunts drew young people into a 'social network that will last all their lives. Before they troop through the politically correct lobby, brimming with self-righteous bile and spiteful prejudice, they should remember the unhappy precedent of 1936 when the revolting Reichsjaeger Hermann Goering persuaded Hitler to ban hunting." That's right Paterson and Hitler didn't smoke either ! do you ?


"We should not create criminals lightly. No-one gained in Germany then. No-one will now. A ban will be an ominous portent of further freedoms to be lost at the hands of an intolerant majority." Tell that to Marian Price ! Oh compassionate hypocrisy, of the horsey set or Paterson himself, who has seen more foxes being ripped apart by a load of hounds than even Brian Faulkner. Perhaps he might change his mind, if he had a pack of dogs chowing his own knackers off. At least Hitler was a vegetarian, unlike Paterson the Fuhrer of Occupied Ireland, who also dictates internment with torture and without trial. Last Summer this insane, autocratic, sociopath, took himself off to one of the last places on Earth, where sadistic fox hunting is still legal, Outer Mongolia!

Like the Mongols, Faulkner and Paterson use state terror and cruelty as a weapon of subjugation of the native irish


Like Paterson the Mongs employed the " Fear Factor of Cruelty " for example in Persia a Mong captured a man but had no sword to kill him. He ordered the man to lie down without moving, while he went and got a sword. Like a lot of her Majesty's commoners today, the man was so terrified, he actually lay there until the Mong came back and beheaded him. When Mongs conquered a city, citizens were slaughtered by impaling, others were forced to watch as Mongs like the sick Paterson, systematically raped the young women, boys and nuns. In Syria they punished a leader, feeding him with pieces of flesh cut and forcibly fed to him until he died similar to the force feeding of Marian Price for 200 days not too long ago. All of this Paterson cruelty, is calculated and used to spread state terror; not just as as a punishment, sometimes it is revenge but never without a reason.


Dictator Paterson apes Genghis Khan's tactics, who built an empire with fear in campaigns with the death of over 40 million people mercilessly, killing boys and and kidnapping women like Marion Price. Genghis Khan said: "The greatest happiness is to vanquish your enemies, to chase them before you, to rob them of their wealth, to see those dear to them bathed in tears, to clasp to your bosom their wives and daughters." Science supports this claim with a map of the Y chromosmes in Euro/Asia having a prevalence of 1/500 of all males directly related to him today.


Today's British gung-ho version of  Genghis Khan is the unelected englishman Owen Patterson, the Queen's Secretary of state for British Occupied Ireland, Last summer he rode for some 40 days for14 hours on much abused ponies with cruelty, from swinger, swapping stations three times daily, where he would sleep on the floor under carcasses of butchered goats, eating goat gristle and sour yak milk. His motto to keep this insanity and cruelty going to the extreme was, "Keep Buggering On ! which concerns many as to the true extent of the abuse and cruelty of the ponies.


Naturally today all decent evolved humans are disgusted with Paterson and his Mong tactics of kidnapping, state terror, censorship and torture. All except his beloved Royal Army Rangers and the disgraced UDR whose military tactics, formation and cruelty has been aped down to the last drop of blood. These are the ones to this very day egg him on as provocation for another 40 years of British mayhem in Occupied Ireland.

The proof of it is the internment of Marian Price without trial in Ireland by Paterson, supported by horsey Tory "social network" in England and its mentored sectarian Orange bedfellows in British Occupied Ireland.

Owen Paterson a Perfidious Insidious Odious Albion Autocrat ?

A long standing respected human rights campaigner and former prison chaplain Monsignor Raymond Murray has stated that the continuing detention of veteran republican Marian Price is internment without trial.

Ms Price was charged with encouraging support for the IRA at an Easter rally in Derry. The judge granted her bail based on the same intelligence reports that the Secretary of State had her ‘release licence’ revoked last May on an offence committed almost 40 years ago. Since then, she has been in solitary confinement prison up to last week. 

Monsignor Raymond Murray said:

“This is a form of internment, I am just shocked that the Secretary of State wouldn’t be aware of how serious nationalist people look on internment.We thought it had all ended and here it is coming under a form of revocation, revoking a license.He would have to explain to us and explain the process of law as regards Marian Price.In any way has she broken the law? That would have to be provided but it is not provided by shoving her into prison on a pretence in an unjust way.”


In an article published on Wednesday 14 December 2011 at 03:11, Eamonn McCann explained it in the following manner:


"The continuing imprisonment of Marian Price in Maghaberry is a scandal and would be seen more widely in this light were it not for her politics.

Ms Price is in jail on the order of Northern Ireland Secretary Owen Paterson, who signed a document last May ordering the police to put her behind bars.

She had been arrested on May 11th and charged with encouraging support for an illegal organisation. This arose from an action at the 32 Country Sovereignty Movement’s Easter commemoration in Derry city cemetery: on a blustery day, she reached up to hold the script from which a masked representative of the Real IRA was reading the ‘Easter Message’.

Two days later Ms. Price appeared at Bishop Street, where she applied for and was granted bail. She was rearrested when she came out onto the steps of the courthouse.

Mr Patterson had signed a document the previous night purporting to revoke the licence on which she had been released almost 30 years earlier from a life sentence for the 1973 Provisional IRA bombing of the Old Bailey.

If the Derry court had remanded Ms Price in custody, the document would not have been produced. We might not know even now that it existed.

It is not clear whether the prosecution had been aware of the document as it argued against bail. What’s clear is that the bail application had been a farce. The role of the court had been rendered meaningless by Mr Patterson preparing the way in advance to have the decision set aside if it went against his wishes.

This was as blatant an abuse of process as can be imagined.

The offence is compounded by the fact that here is real room for doubt whether Mr Patterson had authority to order Ms Price back to jail in the first place.

Her lawyers insist she had been freed from the Old Bailey sentence on the basis of a Royal pardon and that the terms of the pardon supersede the powers of the Secretary of State.

The lawyers have asked three times for the pardon to be produced. Three times, the State has maintained that no copy can be discovered.

At one point, her solicitor was told that the pardon must either have been lost or somehow been shredded.

Thus, Ms Price has spent the last seven months in Maghaberry, not on the basis of conviction for a crime but because Owen Patterson believes that the State is better off with her out of the way. She is imprisoned without trial - in everyday language, interned.

She is the only woman in an all-male prison and thus, for practical purposes, in solitary confinement. She is 57 years-old and in very poor health and in constant pain. But these are not the main reasons she should be released.

She should be released because it is an affront to justice and to the rights of citizens that she has been denied her liberty, and even denied sight of the evidence which Owen Patterson says he has seen and which he claims entitles him to deny her her liberty.

Rights - or privileges

It is difficult to avoid the conclusion that the reason there hasn’t been more of a hullaballoo about this matter is that many of those who might have been expected to stand up for civil rights are repelled by Ms Price’s politics.

Which means in turn that the extent to which civil rights are defended in the political mainstream is to some extent at least determined by the political beliefs of whomever is being denied their rights.

This means that the rights we speak of are not rights at all, but privileges to be granted or withheld according to a politician’s judgment of where the State’s interests lie.

The only adequate response is for all who value civil liberties to tell Mr Patterson loudly and with one voice – Free Marian Price now. "

Pat Ramsey an SDLP MLA who has campaigned for Marian from the outset has said that he has been questioned as to why he was fighting for the release of Marian Price.

"This is a personal thing. It is a right cause," he said. "It is injustice. If Marian Price was my sister, my loved one I would be deeply distressed as to the condition of her health. In the last year she has developed chronic medical problems. If she was my sister and she was on the outside I would be taking her to her GP and her GP would be admitting her to hospital immediately. It is that urgent. If there is any decency left in the world she should be at home, or the next best thing, in hospital."


Deputy First Minister Martin McGuinness has called on the Secretary of State to end the “debacle” over the detention of Marion Price, saying.

“Marian Price is entitled to due process and the revoking of her licence by the British Secretary of State and then claiming that the pardon granted to Ms Price cannot be found is completely unacceptable."

“That action by Owen Patterson amounted to detention without trial and runs contrary to natural justice. The justice system needs to be based on human rights protection; the revoking of Marian Price’s licence and the debacle created around the allegedly lost pardon is an attack on her human rights,” 

.The national chairperson of the 32CSM Mr Francis Mackey today stated "The violation of Marian Price's human rights demonstrates how far the British government are prepared to go with their policy of internment in an attempt to break republican prisoners. This issue of injustice must be exposed for what it is. The plight of Marian Price stands above any political party or organisation and i urge all concerned about the case to come together in a spirit of unity to secure the release of Marian."

Mr Mackey highlighted the politicised nature of Marian's incarceration and stated "The facts are that Marian wasn’t out on licence for it to be revoked. She received a pardon which the British government now claim cannot be found. Only people power can now bring pressure to bear nationally and internationally on the British government. The move to Hydebank is merely transferring the problem. Marian will still be held in isolation and we hope that she receives the medical treatment she urgently requires."

The 32CSM will be escalating our campaign to highlight the case of Marian Price. With International Women’s day approaching on the 8th of March we urge all women’s groups to join us to highlight the case of a mother, wife and sister who is today interned in a British jail. Support Marian Price and work to secure her release.

Five days ago the Northern Ireland Office in the absence Of Owen Paterson having the balls to explain or make a statement himself said the secretary of state "entirely refutes" the allegation that republican Marian Price is being effectively interned without trial."The secretary of state entirely refutes the allegation that this is internment without trial."

The author is not surprised, its same pish the British have served for the last 40 years treating the Irish as fools and justifying to the world, with their BBC type world service propaganda that their perfidious, insidious, odious INTERNMENT without trial legacy of wartime Britain is appropriate after their much touted bad Friday pish process. The Secretary of State is either a fool a liar or both or perhaps a plain perfidious, insidious, odious, Albion, autocrat?
